The December 3, 2009 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act." Present were Board members: Mr. Wolfersberger, Mr. Struncius, Mr. Spader, Mr. Leonard and Mr. Reilly Alternates: Mr. Reynolds and Mr. Ardito

Steve Pardes #2008-03 Christoudias (Harbor Lights) Extension - Motion by Mr. Leonard second by Mr. Reilly to extend Resolution #2008-03 to December 17th, 2009.

In favor: Wolfersberger, Spader, Leonard, Palisi, Reilly, Reynolds and Ardito
Opposed: None

Memorialization of November 5, 2009 minutes – Motion by Mr. Reilly, second by Mr. Reynolds to memorialize the November 5, 2009 minutes.

In favor: Spader, Palisi, Wolfersberger, Reilly, Reynolds and Ardito

Memorialization of November 12, 2009 minutes – Motion by M. Reilly, second by Mr. Reynolds to memorialize the minutes from November 12, 2009.

Application #2009-20 – James Ivchenko – 317 Trenton Avenue – Block 79; Lot 9 – Applicant wishes to add a 39 x 8 foot deck to existing rear deck.

James Ivchenko, applicant, sworn. Steve Brodeur, applicant’s builder, sworn. Steve Brodeur stated that the side yard setback will be 7 feet plus; the issue is building coverage. The deck will be 31 feet 6 inches long. Ray Savacool stated that building coverage will be slightly under34%.
Steve Brodeur stated that the deck will remain open so that water will pass through and recharge. The deck will be no higher than the bottom floor of the home. The shower will have cedar shake siding. The shower will drain into the sewer system; it is piped directly in.


Reynolds: Deck will let water run through. I am in favor.

Leonard: Normally I am one that is concerned with building coverage but you are trying to keep it so it doesn’t block windows and make the home look nice. The water will pass through. The way it is proposed at 31.6 feet I would be in favor.

Wolfersberger: Normally I would have concerns but since the deck is open I would be in favor.

1. The shower is to be sided with cedar shake shingles to match the home.
2. The deck will be built with biome material and allow the water to recharge.
3. The building coverage will be no more than 33.5%
4. The deck is to have lattice skirting.

Motion by Mr. Reilly, second by Mr. Leonard to approve application #2009-20 with conditions

In favor: Wolfersberger, Spader, Leonard, Palisi, Reilly, Reynolds and Ardito
Opposed: None

Mr. Palisi, Mr. Leonard and Mr. Reynolds have listened to prior audio and have signed a certification and are able to vote on the following application.

Application #2008-30 – Ann C. Varosi – 307 Baltimore/302 Chicago Avenue – Block 108; Lots 21 & 22 – Applicant wishes to demolish a single family dwelling on lot 22 and subdivide the lot into two lots. Existing Lot 21 rear property line would be moved. There are two existing principal structures located on lot 21.

Due to unforeseen circumstances the meeting was stopped before this application was heard and Application #2008-30 of Ann C. Varosi was carried to January 21, 2010 without notice.

Meeting adjourned at 8:04pm
