Minutes

The July 16, 2009 Regular Meeting of the Board of Adjustment opened at 7:35 pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Wolfersberger, Mr. Spader, Mr. Moberg, Chairman Struncius, Mr. Palisi and Mr. Reilly Alternates Mr. Reynolds

Motion by Mr. Moberg, second by Mr. Reilly to memorialize the minutes of the June 18, 2009 meeting.
In favor: Spader, Palisi, Struncius, Moberg, Reilly and Reynolds.

Motion by Mr. Reilly, second by Mr. Spader to memorialize the action and vote approving application #2009-02 of Steven Doyle with conditions.
In favor: Spader, Palisi, Struncius, Moberg and Reilly

Motion by Mr. Spader, second by Mr. Reilly to memorialize the action and vote approving application #2009-11 of Michael Rosenberg with conditions.
In favor: Spader, Palisi, Struncius, Moberg, Reilly and Reynolds.

Motion by Mr. Reilly, second by Mr. Moberg to memorialize the action and vote approving application #2009-07 of Edward and Ellen Freeman with conditions.
In favor: Spader, Palisi, Struncius, Moberg, Reilly and Reynolds.

Motion by Mr. Moberg., second by Mr. Reynolds to approve application #2008-29 of Robert Festa with conditions.
In favor: Spader, Palisi, Struncius, Moberg and Reynolds

Application #2009-09 – John and Anita Fiorino – 416 Broadway; Block 161; Lot 4.01 - Applicant wishes to construct an 8 x 12 shed in rear yard.

John Fiorino, applicant, sworn. John Fiorino states that he wants to locate the shed two feet off the property line. Mr. Wolfersberger has concerns over the building coverage, impervious coverage and the fact that the applicant wants to locate the shed two feet off the line in a utility easement. Mr. Reilly inquired why he wants it only two feet off the property line. John Fiorino replied that he wants to preserve the open space for his grandchildren to play in. He needs the shed to store his grandchildren’s bicycles. Jay Reynolds commented on the shed being located on a utility easement. Dennis Galvin stated that the board would not be able to grant permission to place a structure in a utility easement. John Fiorino replied that he can place the shed closer to the rear of his home.

Deliberations

Mr. Reynolds – You are asking for the Board to increase two preexisting non-conformities. Given the facts I am inclined to deny.

Mr. Spader – I think it is too much of a push.

Mr. Reilly – It does not bother me that the home is not in a SF5 zone, but I haven’t heard any other rationale besides that you like it. It increases two preexisting variances and would create a new one; inclined to deny.

Mr. Moberg – The shed would increase two existing non-conformities and create a new one. It also would create massing in the back of the home. Not in favor.

Mr. Wolfersberger – Ditto to what has been said.

Motion by Mr. Moberg, second by Mr. Reilly to deny application #2009-09 of John Fiorino.

In favor: Wolfersberger, Spader, Palisi, Struncius, Moberg, Reilly and Reynolds
