The October 18, 2007 Regular Meeting of the Boar d of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act." Present were Board members: Mr. Wolfersberger, Mr. Simon and Mrs. Tooker Alternates: Mr. Leonard, Mr. Reilly and Mr. Reynolds

Motion by Mr. Leonard, second by Mr. Reynolds to nominate Jim Wolfersberger as acting chair.

Application #2007-08 – Carol Phillips, 200 Washington Avenue; Block 19; Lot 1; Applicant wishes to construct a 12’ x 23’ deck. Carol Phillips, Applicant, sworn. Home is located on a corner lot; requesting side yard setback and building coverage variance; will be constructed out of trek with railing; grass will be located under deck to allow rain to recharge. Deck will be 10 feet by 23 feet. Deck will not be seen from street and will be aesthetically pleasing and will not have a negative effect on neighborhood. Ray Savacool redid calculations to include steps.

Steps will be located in the middle of the 23’ deck and be no greater than 4 feet wide.

Application #2007-11 – First Presbyterian Church; Applicant wishes to continue its educational tradition by re-introducing a weekday nursery school to the existing Christian education building similar to the school conducted in prior years. Michael Steib, attorney for applicant. Requesting limited expansion of use variance to enclose 1,000 square feet of empty lot to be used as a play area in conjunction with the education building which is to be used as a nursery school. Applicant’s Engineer is unavailable this evening so we will have testimony from Carlos E. Wilton and finish on another evening. Carlos E. Wilton, sworn, proceeded to give history of church. Church is involved in outreach and mission work. Manse was built in 1882. Across the driveway is the education annex that was constructed in 1952 for education purposes. Annex originally housed nursery school known as Mrs. Antrim’s nursery School. NA and AA utilize the building for meetings; large scouting program (over 50 years); Sunday school has approximately 80 students; Lot for play area has several beautiful trees which they plan to maintain. Carlos E. Wilton stated that they plan to start small and max out at 64 children. 2 classrooms that hold 20 children and 2 that hold 12 children each; maximum 6 teachers (part-time) and 1 director and the possibility of a custodian. First year we plan on just a morning session; then maybe an afternoon session if there is a need. The applicant is also considering an afternoon outreach program for elementary afternoon care. Anticipating staggering times around High School schedule to avoid congestion. Curriculum offered; Recreational and educational components (Science, mathematics, music, creative arts); very much a preschool program. DYFS has already given the church the preliminary check and said it exceeds state standards except for the need for additional hot water for hand washing. Classes will go one at a time to the play area; 4 classes at about 20minutes at a time. Playground equipment will be pre-school appropriate. Only physical improvements will be hot water and chain link fence. Applicant is not intending to remove any trees, (Considering building bench around base of one of the trees). School will be limited to nursery school and after care program. Children will be dropped off on Forman Avenue; have requested from council to have the three parking spaces by manse and education building to be specified for drop off and pick up.
