DECEMBER 7, 2017 BOA MEETING

The December 7, 2017 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act."

Present were Board members: Mr. Spader, Mr. Kelly, vice chair Reilly, Mr. Dixon, Mr. DePolo and Mr. Davis

Absent – Chairman Struncius, Mr. Schneider, Mr. Reynolds and Ms. Crasper

Motion by Mr. Davis, second by Mr. DePolo to memorialize the action and vote approving application #2017-35 – Dean/Lisa Esposito – 401 Washington Avenue

In favor: Reilly, Dixon, Davis and DePolo

Opposed: None

Motion by Mr. Davis, second by Mr. DePolo to memorialize the action and vote approving application #2017-27 – Robert/Lyn Montefusco – 13 Beachcomber – with conditions

Application #2017-36 - James J. Nazemetz – 163 Ocean Avenue – Block 129.02; Lot 7 – Applicant wishes to construct a second story bedroom.

James J. Nazemetz, applicant, sworn, stated that he has owned the home since 2012. He purchased the home right before Sandy hit. After Sandy he raised his home and renovated the property. Home has always had two driveways which was one of the reasons he bought the home. He is looking to expand the upstairs bedroom which comes to a 65 square foot expansion. He does not rent the home.

Deliberations

Spader – Nice expansion – driveways have been there – in favor

Kelly – Variance were pre-existing – I have no problem with the plan.

Dixon – I like what you are doing with the room upstairs. You’re not really asking for too much. It is a small expansion – nice job rebuilding the house after the storm. It will not be affecting anyone’s light and air.

DePolo - The expansion is minimal – no problem with driveway it was always there. In support of application.

Davis - Agree with all that has been said – Expansion is adding to the improved character of Ocean Avenue.

Reilly – Agree with what has been said – my concern was the expansion – expansion is virtually diminimus. In favor

Application approved

Application #2017-37 – Glen Paesano – 46 Niblick Street – Block 123 Lot: 17 – Applicant wishes to lift existing single family dwelling and add dormers, deck and stairs.

Mr. Dixon is recused from the Paesano application.

Glen Paesano, applicant, sworn, stated that he purchased the home and is raising it and would like to keep some of the original characteristics; foundation and footprint will remain the same. He will be adding some dormers and access. Glen Paesano stated that he believes the house is a nice addition to the neighborhood and it is small in comparison to other homes in the neighborhood.

Gregory Cox, Professional Architect/Planner, sworn, credentials accepted, reviewed plans. He started construction by lifting house by right and when it was lifted realized it lost some appeal when raised so they want to add dormers which would encroach in the setback – also would like to enhance the cape look by adding parking underneath on Niblick. Windows will be added and also a roof porch which will be accessed from the living room which provide a view of the lake. Also would like to add a small front porch with a roof on it and an open deck off the living level in the rear of the house. Mr. Spader inquired when home was built. (1920’s). Home is being brought up to code; essentially a new home.

Deliberations

Spader – Thinks the main highlight is there have been so many big houses – it is nice to see old time charm being kept. Safety factor – variances existing. Will support application

Kelly – Commended the architect on presentation – taking a house in trouble and fixing it up – no problem with application.

DePolo – Pre-existing conditions – not expanding footprint – safety upgrades – in full support of application.

Davis – As has been said – over all positive impacts outweigh any negative if there are any.

Reilly – Questioned if there is any way that we can deal with the problems that come up with the corner lots. Ray Savacool replied that Mayor and Council had considered amending the ordinance but too many things came into play. Could not come up with a way to keep the aesthetic quality and stated that the Board works very hard especially on corner lots to keep the side view aesthetically appealing.

Motion by Mr. Spader, second by Mr. Kelly to approve application #2017-37 of Glen Paesano – 46 Niblick Street – Block 123 Lot: 17 with conditions

In favor: Spader, Kelly, DePolo, Davis and Reilly

Opposed: None

Application approved with conditions


Application #2017-33 – Donald/Kimberly Cummins - 107 Forman Avenue – Block 68; Lot 4 – Applicant would like to convert detached assessor structure (art studio) to cabana and install an in-ground pool.

(Applicant requesting to be carried to March 15, 2018 without notice)

Motion by Mr. Spader, second by Mr. Kelly to carry application #2017-33 – Donald/Kimberly Cummins - 107 Forman Avenue – Block 68; Lot 4
