December 6, 2017 PB minutes

The December 6, 2017 Regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members: Mr. Ritchings, Mr. Paesano, Vice Chair Russell, Chairman Ammirata, Mr. Babbini and Ms. Villani
Absent: Mr. Tighe and Mr. Gant

Also present Dennis Galvin, attorney, Ray Savacool, Engineer and Karen Mills, Clerk/Secretary

Motion by Mr. Ritchings, second by Mr. Paesano to approve the minutes of October 4, 2017
In favor: Ritchings, Babbini and Villani
Opposed: None

Approval of 2018 meeting dates

Motion by Mr. Ritchings, second by Mr. Paesano to approve the meeting calendar for 2018

Application #2017-403 – Advance Investments, LLC – 516 Bay Avenue Unit 3 – Block 90; Lot 12.03 – Applicant seeks site plan/change of use approval to permit a change from retail to restaurant within an existing storefront.

Kimberly Bennett, Esq., attorney for applicant reviewed the application. The restaurant will be named “Raw Poke Bar”. Gregory Cox, Professional Architect and Planner, sworn, reviewed the proposed restaurant use and floor plan. Trash will be stored inside and picked up every morning. Cooking will be limited and not require an exhaust fan. Business plan is mostly for a quick service and take-out. It is not a destination restaurant; parking need for this type of restaurant is minimal. Gregory Cox believes that the High school students and that people who already have a parking spot for shopping will be the clientele. Mr. Paesano questioned the type of waste and how it would be stored – in garbage cans and picked up daily (6 to 7am). Will be open all year from 11am -6pm during the week and open later on the weekend.

Matthew Rega, applicant, sworn stated that there has been nothing like this before and he believes it will add to the community. It is sushi in a bowl – you get your base (rice or greens) then your protein and proceed down the line for toppings. Basically Ahi tuna, Salmon and tofu will be the proteins. Dennis Galvin questioned if he will need any heating element like a microwave. (Matt Rega – Maybe) Ms. Villani questioned if there will be a rice cooker (Yes) She explained that is cooking. Greg Cox stated there will not be a commercial cooking hood. Matt Rega requested to have limited cooking (for chicken and shrimp) that will not require and exhaust system.

Chairman Ammirata explained that somewhere down the line if he wants to do cooking he will need to come back to the board. Matt Rega stated that he will use signage similar to the existing signage and not exceed the zone requirement.

1. All trash is to be stored within the building and be picked up daily.

2. While there is generally to be no cooking on site, the Board authorizes the use of a rice cooker, a microwave and equipment to cook, chicken or shrimp, provided it does not need to be vented or exhausted by code.

Ordinance Review and Recommendations

Ordinance 2017-30 – AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING CHAPTER XIX OF THE BOROUGH CODE ENTITLED “DEVELOPMENT”




The Planning Board reviewed and considered Ordinance #2017-30 and voted to support it with a vote of 4 to 2 with the recommendation to allow medicinal marijuana sales from a licensed pharmacy that also provides conventional medications.

In favor: Ritchings, Paesano, Villani and Ammirata
Opposed: Russell and Babbini (Support ordinance as is)






ORDINANCE 2017-31 - AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING CHAPTER XIX OF THE BOROUGH CODE ENTITLED “DEVELOPMENT”

The Planning Board reviewed and considered Ordinance #2017-31 and voted unanimously to recommend the ordinance as is.

In favor: Ritchings, Paesano, Russell, Babbini, Villani and Ammirata
Opposed: None
