ORDINANCE 2017-05 Extend Fire Co Applicant Residency Radius to 7 Miles

ADOPTED: March 21, 2017

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING CHAPTER II
OF THE BOROUGH CODE, ENTITLED “ADMINISTRATION” AT SECTION 13, ENTITLED “DEPARTMENT OF FIRE.”

WHEREAS, the Governing Body of the Borough of Point Pleasant Beach (hereinafter “Borough”) has found that it is in the public interest to revise the residency requirements for membership on the Borough’s volunteer fire companies so as to increase the available geographical area for members; and

WHEREAS, the Borough’s Department of Fire has requested a seven mile radius from the borders of the Borough as the geographical requirement for membership.

NOW, THEREFORE, BE IT ORDAINED, by the Governing Body of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey, as follows:

SECTION I.

Chapter II of the Code of the Borough of Point Pleasant Beach, entitled “Administration,” Section 13 entitled “Department of Fire” shall be amended follows:

The language in section 2-13.1(h)(2) that reads:

“Be a resident of the Borough of Point Pleasant Beach or its contiguous communities and be at least 14 years of age.”

is hereby deleted, and replaced with:

“Be a resident of the Borough of Point Pleasant Beach or be resident within seven (7) miles of any border of the Borough and be 14 years of age. For the purposes of calculating the seven mile distance a “border” ends on the shoreline of any body of water extending beyond a border.”

SECTION II.

All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.

SECTION III.

In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.


SECTION IV.

This Ordinance shall take effect immediately upon its final passage and publication as required by law.


SECTION V.

The Borough Clerk is hereby directed, upon adoption of the Ordinance after public hearing thereon, to publish notice of the passage thereof and to file a copy of this Ordinance as finally adopted as required by New Jersey law.

NOTICE

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and approved on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 7th day of March, 2017 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 21st day of March, 2017 at 7:30 p.m. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey, at which time and place any person desiring to be heard will be given an opportunity to be so heard.
