The April 6, 2016 Regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members Mr. Dooley, Mr. Ritchings, Mr. Winter, Chairman Ammirata, Councilman Migut, Mr. Sheehan and Mr. Corbally
Absent – Mr. Liotta and Ms. Devon
Also present: Karen Mills, Dennis Galvin and Ray Savacool

Motion by Councilman Migut, second by Mr. Ritchings to memorialize the minutes of March 2, 2016 –

Motion by vice chair Winter, second by Mr. Ritchings to memorialize the actin and vote approving application #2016-379 –of Findencio Lucero d/b/a Julia Mexican Restaurant – 1308 Richmond with conditions

Application #2016-395 – Spano’s Restaurant - 719 – 721 Arnold Avenue – Block 202; Lot 10 – Applicant wishes to expand restaurant into adjoining space.

Michael Schaller attorney for applicant stated the applicant is here for minor site plan approval for their restaurant located on Arnold Avenue. Joseph Spano applicant, sworn, stated that restaurant is open 7 days a week from 4pm until 10 pm.. Parking in rear of building for staff; has added the space in the adjoining building to his business for extra pace. The expansion has added a net of 16 seats. The restaurant is now much more efficient. The rear pods have been removed; dry storage is now kept in the rear of the new space.

Ritchings – Straight forward application; existing use – just expanding seating.

Paesano – Sees no negative impact; only sees positives.

Ordinance #2016-05 – Zoning certain parcel’s on the west side of Ocean Avenue and permitting parking in retail establishment’s parking lots to provide additional parking for the resort commercial district.


Ray Savacool, board engineer presented the ordinance to the Board explain what would be effected by the passing of the ordinance.

Mr. Dooley inquired if residents could just tear down their home and be a parking lot. Yes – with site plan approval. Mr. Dooley has a lot of reservations about this ordinance. He also is worried that it will take a lot of money away from the municipal lot. He questioned of this was spot Zoning. Dennis Galvin stated that even the fact that one person mostly owns the lots that it is not spot zoning. Mr. Dooley believes that this will affect the value of the homes next to these lots.

Mr. Winters is also concerned that more parking lots will mean more cars. He stated that he looks for a balance between business and residents. Believes this just benefits the businesses. We are going to have more cars in town; if you can tell me there will not be cars in front of my home I would be all for it but they will park in front of my home first because it is free.

Mr. Paesano stated that the ordinance about parking in district 4 after 11pm pushed all the drinkers into the Municipal lot and it is easier to police. This ordinance moves them all over Ocean Avenue again. It will take more police to patrol the multiple lots. The town’s only source of revenue comes from parking. You will being taking revenue away from the town but we will need to pay more police to patrol these other lots.

Councilman Migut stated that he directed the Borough attorney to draft this ordinance and read a statement into the record.

Dennis Galvin reminded the Board that the property owners would need site plan approval.

Mr. Winters stated but then it would be a permitted use so it is going to happen.

Ray Savacool stated that the ordinance would change the parking space size from 10 feet by 20 feet to 9 feet by 18 feet.

Mr. Paesano said that he was on the Master Plan review committee and they never discussed anything like this. Does not believe that this benefits the residents or taxpayers. Takes revenue away from the town. Ocean Avenue is supposed to be the buffer zone for the residents.

Mr. Winter said if one person owned all these lots and came before us and said parking bonanza we would say “whoa”. Making this RC junior would do just that. Way over reaching.

Ordinance #2016-08 – Permitting parking in retail establishment parking lots abutting Inlet Drive

Ray Savacool explained that this would allow Ken’s Landing to park cars.

Glen Paesano inquired what the buffering requirements would be. Ray Savacool replied a 4 foot buffer with screen plantings no higher than 4 feet.

Councilman Migut stated that the Board could suggest to increase the buffer zone.
Ed McGlynn, attorney for the Storino’s explained the overlay zone. He pointed out which lots already have parking and why they would want it to be a permitted zone. He suggested it be limited to RCP zone (just parking). They are not interested in doing anything else. They have no objection to being limited to parking.

The following residents made comments not supporting the ordinance.
