Minutes

The February 4, 2016 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act." Present were Board members: Mr. Kelly, Mr. Spader, Chairman Struncius, Mr. Reynolds, Mr. Dixon, Mr. Schneider and Mr. Davis

Absent – Vice chair Reilly, Mr. Renner and Mr. DePolo

Also present – Andrew Leimbach, Ray Savacool and Karen Mills

Motion by Mr. Spader, second by Mr. Reynolds to memorialize the minutes of January 21, 2016

Memorialize Resolutions
Motion by Mr. Spader, second by Mr. Reynolds to memorialize the action and vote approving resolution #2015-57 of Marcy McLoughlin – 212 Central Ave – with conditions

Motion by Mr. Spader, second by Mr. Reynolds to approve the extension of resolutions 2006-45, 46 and 47 of Jenkinson’s South, Inc. until June 30, 2017.

Application 2014-30/31 of William Focazio, 23, 24, 41, 41A and 43 Inlet Drive - are not being heard at this meeting. They will have to notice when the application is re-scheduled.
Application #2016-13 – Elizabeth Johnson – 732 Grove Street – Block 203; lot 9 – Applicant is seeking a certification of pre-existing non-conforming use (two-family)
The applicant’s daughter at this time does not have her mother’s power of attorney with her and has been advised to seek professional help and will be heard on March 17, 2016
Motion by Mr. Reynolds, second by Mr. Kelly to carry application #2016-13 of Elizabeth Johnson to March 17, 2016 without notice

Application #2016- 07 – Daniel/Patricia Adams – 1505 Oceanfront – Block 13.11; Lot 7 - Applicant wishes to construct a new FEMA compliant single family dwelling.
John Giunco, Esq., attorney for applicant, reviewed why the applicant was before the board. The home conforms with the exception that it does not front on a public street. Jeffrey Carr, professional engineer reviewed the conditions and explained it is a simple rebuild.
The applicant agrees to install pavers to the town’s alley for the two homes (Connolly and Adams) with the town’s approval to improve access for the resident’s located on the alley.
Daniel C. Adam’s applicant, sworn stated that the alley at this time is sand and the pavers will make accessibility easier and cleaner. It will also assist an emergency vehicle if needed.

Audience questions/comments
Gail Connolly, neighbor, sworn, stated that she is in total agreement to the improvements.
Chairman Struncius explained that the board does not have control over the alley but the board will be on record that it agrees with the proposed improvement, but it is up to Mayor and Council to approve.

Deliberations
Spader – Thinks it is nice the neighbors agree on the improvements.
Kelly – Happy to see the home are aligning; agree that the alley does need something.
Reynolds – Cannot speak for the council but will go on record that something is needed.
Dixon – Echo everyone’s comments – it is a win win – Town will get a paver road.
Schneider – See’s no issues – neighbor is supportive – nice location and do not see the alley being an issue. It will be a nice improvement for the area.
Davis – See the variance request as being diminimus. Even though we have no jurisdiction over the alley.
Struncius - Does not see the pavers as an issue. The plans are beautiful – good luck with it all.
Motion by Mr. Reynolds, second by Mr. Spader to approve application #2016-7 of Daniel/Patricia Adams. 1505 Oceanfront
In favor – Spader, Kelly, Reynolds, Struncius, Dixon, Schneider and Davis
Opposed: None

Application #2016-11 – James/Ann Marie Ireland – 405 Trenton Avenue – Block 78; Lot 3 -Applicant wishes to elevate existing single family dwelling and construct a new front wrap around porch and rear deck.
James Ireland, applicant, sworn, stated that they are raising their home and would like to add a porch. Exhibit A-3 – Chart which shows front yard setbacks on his block. He will still be setback further than other homes on the block after the addition of the porch. Front porch will be covered. Rear deck is 2 ½ percent coverage.
William Taylor, Professional engineer, has appeared before Boards in Montclair, Short Hills and has served on the Bay Head Planning Board, credentials accepted. Applicant will adhere to the ordinance as far as the foundation is concerned.

No audience questions/comments

Deliberations
Spader – The only concern he would have had is the front yard setback but the applicant is consistent with the setbacks in that part of town. It is proportionate to the property.
Kelly – Agrees with Mr. Spader and thinks it will be a wonderful addition.
Reynolds – Likes the drawings and will be in favor.
Dixon – Nice drawing of the home and it fits nicely in the neighborhood. It will be nice in your twilight years to sit out there with your grand kids.
Schneider – Plenty of room and you are going up a modest amount
Davis – With the massing of the home I think the porch will be a nice addition and be diminimus and certainly acceptable.
Struncius – Anytime we see a building coverage get up into the mid 30% it is alarming to the board, but with the aesthetic value of the porch and the percentages including open decking and stairs there is good reason behind it.

Motion by Mr. Spader, second by Mr. Kelly to approve application #2016-11 of James/Marie Ireland 405 Trenton Avenue with conditions
Condition – Foundation must adhere to the ordinance
In favor – Spader, Kelly, Reynolds, Struncius, Dixon, Schneider and Davis
Opposed: None



Application 2016-05 – John/Karen Reccia – 2016 Chicago Avenue – Block 133; Lot 1 – Applicant wishes to elevate existing single family dwelling and re-construct a sun room.
(Reccia application will be heard at a future date)
