MINUTES

The December 3, 2015 regular meeting of the Point Pleasant Beach Board of Adjustment opened at 7:30 pm. The clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members: Mr. Spader, Mr. Kelly, Chairman Struncius, Mr. Reynolds, vice chair Reilly, Mr. Dixon, Mr. Loder, Mr. Davis and Mr. DePolo
Absent - Renner
Also present, - Dennis Galvin, Ray Savacool and Karen Mills
Motion by Mr. Reynolds, second by Mr. Loder to memorialize the minutes of October 1, 2015

Application #2015-61 – Stephen/Agatha Ruddy – 306 Forman Avenue – Block 61; Lot 17 – Applicant wishes to raise existing single family dwelling and add front porch, rear deck and in-ground swimming pool.
Agatha and Stephen Ruddy, applicants, sworn. Stephen Ruddy stated that they have lived in the home for 10 years and they are in the process of lifting the home and would like to add a porch. The applicants have agreed to make the pool conforming.
Greg Cox, Professional Architect, stated that they have a great opportunity to improve the home. They are going to make significant aesthetic improvements and eliminate the look of the home being a bi-level. Ground level will be storage and garage; home will be a little higher and first floor walls will be 9 feet and still be under the height limitation. The porch will be 7 feet wide and only encroach the front yard setback by 2 feet. All other bulk requirements will be met. Rendering depicts the colors that will be used.

Deliberations
Loder – With the information presented will be in favor
Spader – The home will fit in nicely with the neighborhood and with the pool issue resolved will be in favor.
Kelly – With the pool issue resolved has no problem with application. In favor
Reilly – Only question had been about the pool, in favor
Reynolds – Like wise
Dixon – FEMA compliant home –modest request - in favor
Conditions
1. Home should be constructed as described to the board at the time of the hearing.

Motion by vice chair Reilly, second by Mr. Reynolds to approve application #2015-61 –of Stephen/Agatha Ruddy – 306 Forman Avenue – Block 61; Lot 17 with conditions

Application approved with conditions

Application #2014-30 – Dr. William/Deborah Focazio – 45 Inlet Drive – Block 175/Lot 23 – Applicant wishes to demolish existing dwelling and construct a new FEMA compliant single family dwelling with parking underneath.

Application #2014-31 – Dr. William/Deborah Focazio – 41, 41A and 43 Inlet Drive – Block 175/lot 24, 25.01 and 25.02 – Applicant wishes to demolish three (3) single family dwellings. Three lots would merge and a new FEMA compliant two-family dwelling would be constructed on one lot with parking underneath.
Chairman Struncius and Mr. Loder have listened to the audio from the October 16, 1014 meeting and signed a certification attesting to this fact.

Dennis Galvin believes though that the applicant can start fresh since it is a new application and design.
John Jackson, attorney for applicant, stated, they have Jeff Carr, Professional Engineer and James Peter Kokkalis, PA/PP as expert witnesses. Justin Aiello, is also present as Professional Planner. James Kokkalis, presented his rendering which depicted connecting both homes which are located on separate lots with a deck. Mr. Reynolds inquired what the distance is between the two homes (10 feet).

There are 2 units in one home and one unit in the other; Mr. Reynolds said it looks like one property being connected with the porch. Dennis Galvin stated that it could be combined into one lot. Mr. Jackson said they could go into a condo form of ownership. Dennis Galvin stated that you would still need easements with the two properties if they are sharing property. Who would maintain the deck? Mr. Davis inquired if one unit could be sold off? John Jackson stated that a unit could be sold off if they had a condo form of ownership. John Jackson said that they believe that this is a creative utilization of the property but they are open to suggestions if they have to change something to get this built. Chairman Struncius feels the scale of the stone is very strong and over powering. John Jackson stated that he does not believe that this lot is suitable for a commercial use.
Audience questions of the architect
Lee Miller 47 Inlet Drive – Questioned the height of the home (47.5 feet). She inquired if this is zoned ROS (no)
Dave Cavagnaro – 118 Parkway – Questioned if the floor conforms to the ordinance of 2nd floor being 85% of first floor (No) but time of application rule applies to this.
Jeffrey J. Carr, PE, sworn, credentials accepted, reviewed Board Engineers letter. Applicant agreed to change to crushed stone under the home. John Jackson believes that the pool is an appropriate use for this property. Much conversation ensued over the parking and access.
Audience questions of engineer
Lee Miller – 47 Inlet Drive – Questioned the stairway and how it will impede on the other residents pulling in the driveway. (It was discussed how it would limit the turn ability and the applicant stated that they would relocate the stairs)
The Board members had many concerns with this application. John Jackson the applicant’s attorney stated that the applicant has taken into consideration the comments of the board and would like to adjourn to a future date so he can make some changes and scale it back a little more.

Motion by Mr. Spader, second by Mr. Loder to carry to February 4, 2016 without notice
