Minutes

April 1, 2015 regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members Mr. Dooley, Mr. Ritchings, Mr. Winter, Chairman Highton, Ms. Devon and Mr. Cavagnaro
Absent: Councilman Migut, Mr. Paesano and Mr. Corbally
Also present: Karen Mills, Dennis Galvin and Ray Savacool
Motion by Mr. Cavagnaro, second by Ms. Devon to memorialize the minutes of February 4, 2015 meeting

In favor: Dooley, Ritchings, Winter, Devon Cavagnaro and Highton
Opposed: None

Motion by Mr. Cavagnaro, second by Mr. Winter to memorialize the action and vote approving application #2014-378 of Lombardi Residential minor subdivision – 207 -209 River Avenue with conditions.

In favor: Dooley, Ritchings, Winter, Devon, Cavagnaro and Highton
Opposed: None

Application #2014- 380 – John Amelchenko – 421 River Avenue – Block 112; Lots 10 & 11 – Minor subdivision
Applicants notice was deficient –

Motion by Chairman Highton, second by Mr. Dooley to carry application #2015-380 of John Amelchenko to May 6, 2015 without notice considering his neighbor waives time of notice.
In favor: Dooley, Ritchings, Winter, Devon, Cavagnaro and Highton
Opposed: None

Application #2014-379 – Nascimento/Maria Ruela – Applicant previously obtained approval to remove a three family structure and construct the two existing homes. Proposal is to subdivide to provide two separate lots.
Daniel Popovich, attorney for applicant reviewed past history of property. Applicant had reduced density of property from three family to two family. Now the applicant would like to subdivide the properties.
Robert Burdick, PP/PE reviewed Ray Savacool’s letter.

Findings of fact
Mr. Ritchings – Thinks this is a rational solution to an existing condition.
Mr. Winter – Very troubled that it is going to be two small lots. Wouldn’t have a problem if the SF5 zone said by the way…When you have these things you should have smaller lots.
Mr. Dooley – commented that there are other lots nearby that are similar; not unusual for that location.
Ms. Devon – Agrees with Mr. Ritchings and believes that it is a sensible solution.
Mr. Cavagnaro – Agrees – The houses are very well done; believes the tax payers are better off with two separate homes on two separate lots. The fact that they both face separate streets is rather unique.
Chairman Highton – Agrees with everything that has been said. Thinks it is logical with the new construction to subdivide rather than the condominium alternative.

Motion by Mr. Cavagnaro, second by Ms. Devon to approve application #2014-379 – Nascimento/Maria Ruela – Block 111, LOT 8: 334 River Avenue & 319 Richmond Avenue – Minor Subdivision – with conditions

Conditions
1. The subdivision is to be perfected by map not deed.

2. Prior to the filing of the subdivision map the fence will be moved to the proper location on the lot line.

3. The filed map must indicate which property owner owns the rear fence.
