March 4, 2015 regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members Mr. Gagnon, Vice-chair Paesano, Mr. Winter, Councilman Migut, Mr. Dooley, Chairman Highton, Ms. Devon, Mr. Cavagnaro, Mr. Ritchings and Mr. Corbally
Absent: Ritchings and Corbally,
Also present: Karen Mills, Ben Montenegro, conflict attorney and Ray Savacool
Motion by Mr. Cavagnaro, second by Councilman Migut to memorialize the minutes of February 4, 2015 meeting

In favor: Cavagnaro and Migut
Opposed: None

Motion by Councilman Migut to memorialize Resolution #2014-377 of 1500 Richmond LLC with conditions. (Correction made to resolution that they will provide a fire hydrant at the end of the lane)

Application #2014-378 - Lombardi Residential, LLC
Minor Subdivision 207 -209 River Avenue
Block 118; Lot 14 & 15, Zone SF 5

Applicant wishes to subdivide existing property into three (3) separate lots for single family homes.

Daniel Popovitch, attorney for applicant, stated that these are three conforming lots. Density will be reduced to single family homes.

Robert Burdick, Engineer for applicant, sworn, stated that this is an application for a minor conforming sub-division. Property is within the SF5 Zone and it is lots 14 and 15. Property currently contains a three family unit which will be abandoned and will now be a single family conforming use. Plan is to subdivide these two lots into three single family home lots. The one problem will be the access and are proposing the two ingress/egress which needs to be approved by the DOT. These are conforming lots so architectural have not been submitted but the homes will be conforming or they will end up before the Board of Adjustment. Vehicles will go straight out on Route 35. Exit drive from 14.03 will be removed. The damaged curb will be repaired and sidewalks will be provided at the site. Street trees are not required by ordinance but the applicant will maintain some of the existing property trees and add two (2) trees on the highway frontage. Driveway easement will be memorialized by deed.

Mr. Cavagnaro was concerned with site lines if trees are planted on highway. Chairman Highton looked for a compromise of one street tree per lot. Agreed - Branches will be trimmed at bottom for clear view.

Councilman Migut Removing non-conformity lots are oversized and homes will be conforming. Will be in favor.

Mr. Winter Anytime you get rid of a three family and put in a one family it is a good thing. In favor

Motion by Councilman Migut, second by Mr. Winter to approve application #2014-378 of Lombardi Residential, LLC with conditions

1. Applicant agreed as a condition to provide a driveway easement by Deed which shall be subject to the review and approval of the Board Engineer and Board Attorney for Lots 14.01 and 14.02 as depicted on the plan; as well as to maintain the dual driveway for Lot 14.03.
2. Applicant agreed as a condition that a Lot Grading and Drainage Plan shall be submitted for review and approval to the Board Engineer prior to the issuance of a Construction Permit per Borough ordinance.
3. Applicant agreed as a condition that the two units currently vacant must remain vacant until the conversion of this structure to a single family home (Lot 14.03).
4. Applicant agreed as a condition that no Certificate of Occupancy for new construction Lot 14.01 and Lot 14.02 shall be granted unless and until the structure on Lot 14.03 is converted to a single family residential home.
