ORDINANCE 2014-24 Amend Fire Lane Ordinance

ADOPTED: October 21, 2104

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER XV ENTITLED “UNIFORM FIRE SAFETY ACT” TO ADD RIVER VISTA LANE TO THE LIST OF FIRE LANES, TO AUTHORIZE SIGNS ADVISING OF RESTRICTIONS ON USE OF THE PUBLIC RIGHT OF WAY AND TO AMEND THE DESCRIPTION OF THE FIRE LANE PORTION OF CEDAR AVENUE

WHEREAS, the Planning Board Resolutions creating the individual lots on River Vista called for the creation of a fire lane the entire length of River Vista Lane; and
WHEREAS, it has been brought to the Governing Body’s attention that vehicles are not respecting the fire lane; and
WHEREAS, in order to properly enforce the fire lane restriction on River Vista Lane an amendment is necessary to Chapter XV of the Municipal Code of the Borough of Point Pleasant Beach;
NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey as follows:
SECTION 1. Section 15-14 of the Code of the Borough of Point Pleasant Beach entitled “Fire Lanes” is hereby amended to add the following language to the descriptions of fire lanes in the Borough:
Name of Street Sides Location
River Vista Lane Both Entire length from Curtis Ave. on the east, including the entire turn around area on the west end
SECTION 2. A sign stating “No Trespassing by Minors from 10PM until 6AM” shall be installed at the point on River Vista Lane where access to the river is permitted.
SECTION 3. The description of the fire lane on Cedar Avenue shall be amended to replace the word “south” with the word “east.”
SECTION 4. All ordinances, or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.

SECTION 5. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.
SECTION 6. This Ordinance shall take effect immediately upon its final passage and publication as required by law.

NOTICE
NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and approved on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 7th day of October 2014 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 21st day of October 2014 at 7:30 p.m. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place any person desiring to be heard will be given an opportunity to be so heard.
