Minutes

The August 6, 2014 regular meeting of the Point Pleasant Beach Planning Board opened at 7:30 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members Mr. Gagnon, Chairman Migut, Mr. Winter, Ms. Devon, Mrs. Mutter, Mr. Ritchings and Councilman Cortes
Absent: Loder, Highton and Paesano
Also present: Karen Mills, Dennis Galvin and Ray Savacool

Motion by Ms. Mutter, second by Ms. Devon to memorialize the minutes of the July 2, 2014 meeting

Motion by Ms. Devon, second by Ms. Mutter to memorialize the action and vote approving application #2014-371 of Scot Dolan, 637 Arnold Avenue with conditions

Application #2014-369 – The Clayton Family, LLC – 813 Arnold Avenue – Block 200; Lot 1 – Applicant seeks to restripe the existing parking lot on the westerly side of the building in a manner consistent with the parking lot on the easterly side.

Jim Clayton, Esq. and applicant explained the revised plan. Charles Gilligan, Engineer, sworn. After last meeting he has eliminated six (6) parking spaces, 54 spaces to 48 spaces, and will put in post and rail fence. Cars will only be able to make left turn to exit on Timber Lane; this will improve circulation in parking lot and reduce traffic on Timber Lane. There will be one entrance on Arnold and one exit. The applicant will install four (4) arborvitae near northeast corner of parking lot. Applicant still requesting waiver for 10 foot by 18 foot parking stalls. This restricts access to Timber Lane and that was the main concern of the neighbors. Jim Clayton stated that this will be an improvement to the property and no detriment to the neighbors.

Conditions

1. Should the building uses combine in such a way that would requires more parking than provided, the applicant will seek further relief from the Board in accordance with the ordinance.

2. The applicant is to seal the parking lot, install a split-rail fence, plant landscaping shrubberies and restripe the parking lot as shown on the revised July, 10, 2014 plan.

Deliberations

Councilman Cortes – Is very happy with the changes.

Mr. Ritchings – This is a better plan; it improves the circulation of the parking lot.

Application #2014-375 – Trencin Realty Company - 500 – 504 Trenton Avenue – Lots 12, 13 and 14 - Minor sub-division- Applicant is seeking to subdivide the existing (3) three lot parcel into (3) single-family residential conforming lots.

Dennis J. Cantoli, Esquire, stated that the applicants propose to subdivide an existing parking lot into three (3) single-family conforming lots. The existing lot is currently used as additional parking for the neighboring law office. Additional parking is no longer needed, as the firm has downsized

The board finds land area of the existing parking lot allows for the subdivision of three (3) parcel lot without the need for any variances or waivers and there are no negative impacts arising from this proposal that would affect light, air, or privacy of the surrounding property owners.

Application #2014-376 – Joe Leone’s – 510 American Legion Way – Block 89; Lots 6 & 7 – Applicant proposes minor revisions to the approved site plan; applicant would like to add several carts and tables outside the store.

Scot Kenneally, Esq. Attorney for applicants, Joe Leone Introna and John Hilla, sworn, stated that they have a basic application to amend the site plan to permit the installation of seven (7) concrete picnic tables and benches along with five (5) fruit/vegetable carts.

John Hilla, stated that they want to have sales stations outside to sell produce/flowers and seasonal fruit. They also want to have outdoor seating so people may enjoy a sandwich. There will be no outside table service. It will add a different dimension to their business and help serve the existing clientele. Joe Leone Introna stated it will enhance the look and enable them to give the best product. Mr. Ritchings inquired how it will affect the shared parking lot since people will be hanging round longer. John Hilla replied that people now sit in their cars and eat so it will not make much of a difference.

Conditions


1. Carts may be added outside of the building, but only between the months of April and October, and only during Joe Leone’s regular business hours. A cart may also be used outdoors on both Christmas and Thanksgiving Eve.

2. The carts and outdoor seating are to be neatly maintained.

3. There is to be no waitress service for the outdoor seating. The purpose of the seating is strictly for takeout food use. This restriction is to be recorded as a deed restriction within 30 days of the memorialized resolution. The deed restriction is to be reviewed and approved by the Board’s Attorney prior to the recording.

4. The plan is to be revised to move the tables nearest Richmond Avenue to the American Legion way aka “Laurel Avenue” side.

5. The applicant is permitted to utilize an umbrella at each of the seven (7) concrete tables.
