March 26, 2014


The March 26, 2014 special meeting of the Point Pleasant Beach Planning Board opened at 7:30 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members Mr. Gagnon, Mr. Ritchings, Chairman Tom Migut, Mr. Highton, Ms. Devon, Mrs. Mutter, Mr. Paesano and Councilman Cortes
Absent: Loder and Pasola
Also present: Karen Mills, Dennis Galvin and Ray Savacool

Motion by Mr. Ritchings, second by Ms. Devon to memorialize the minutes of March 5, 2014
In favor: Gagnon, Ritchings, Migut, Cortes, Highton, Devon and Mutter
Opposed: None
Motion by Mr. Highton, second by Mr. Ritchings to memorialize the action and vote approving application #2014-355 of Payton Point LLC with conditions
In favor: Gagnon, Ritchings, Highton, Cortes, Devon, Mutter and Migut
Opposed: None

Motion by Mr. Ritchings, second by Mr. Gagnon to make a motion of support for the Community Forestry Plan

Application #2014-367 Peter Gudaitis d/b/a Steam and Anchor 416 Richmond Avenue Block 94; Lot 3 Applicant is applying for a change of use site plan to permit improvements to an existing two story building proposed to be utilized as a custom donut shop/restaurant.
Peter Kearns, attorney for applicant stated the application is for site plan approval for the subject building to be utilized as a custom donut shop. Current use is residential upstairs with business downstairs. Requesting to utilize north side of building for retail sale.
Peter Gudaitis, 616 Ocean View Road in Brielle, NJ, applicant, sworn, stated that he is the contract purchaser of subject property. Intention is to keep building the same, but to change the north side of the store to donut/ specialty bakery/smoothie retail store. At present time there are two residential tenants upstairs who will remain. Requesting a few tables to be located inside. Hours of operation will be year round with fluctuating hours. Mainly early morning till afternoon hours with approximately four (4) employees.
Chairman Migut inquired how many tables the applicant is requesting to have outside. (Five/5)Would like to have some alfresco dining weather permitting.

Chairman Migut also inquired about the signage. (Etc. sandwich boards) Applicant replied that he would like them out for the opening and then will comply with all sign requirements. Peter Gudaitis also stated that the existing planter will need to be modified. Seating on side of building will not diminish existing parking spaces. Total interior seating will be twenty-two seats. Mr. Paesano inquired about the dumpster location (will remain where it is presently located). The dumpster area will be updated and locked.

Stanly Hans, Jr, Professional Planner, has testified previously before Point Pleasant Beach, Toms River and Brick town boards. Credentials accepted. Reviewed Ray Savacool, Board Engineers review letter. Stanly Hans noted that all variances are pre-existing and believes the applicant complies with the Municipal Land Use Law since it provides aesthetic improvements to the area and can be granted without being a detriment to the zone.
Chairman Migut inquired about the awning. Applicant requesting to continue awning across North side of building. Lighting will not be amplified. Parking spaces will have designated signage.

1. No table shall be placed on the sidewalk in front of the building.
2. Outside seating may not be enclosed or heaters installed.
3. No waiter/waitress service in the outside seating area.
4. Outside lighting shall be compliant with the Borough ordinances.
