ORDINANCE 2013-22 Clarification Hotel/Motel License Exception

ADOPTED: JUNE 18, 2013

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY, AMENDING AND
SUPPLEMENTING CHAPTER IV OF THE BOROUGH CODE, ENTITLED
“ALCOHOLIC BEVERAGE CONTROL”



BE IT ORDAINED, by the Mayor and Council of the Borough of Point Pleasant Beach, County of Ocean, State of New Jersey, as follows:

SECTION I. Chapter IV of the Borough Code, entitled “Alcoholic Beverage Control,” shall be amended and supplemented at section 4-3.1, entitled “Types of Licenses” as follows:

“4-3 Types of Licenses.

4-3.1 Type and Number of Licenses; Fees.
The classes of license, annual license fees and maximum number of licenses for the sale or distribution of alcoholic beverages in the Borough of Point Pleasant Beach shall be as follows:
a. For the licensing year from July 1st through June 30th of the following year, the following fees shall be applicable:

All license fees shall continue in effect until such time as they are changed by an appropriate ordinance.

4-3.2 Hotels and Motels.
The limitations on the number of licenses set forth in subsection 4-3.1 shall not prevent the issuing of a plenary retail consumption license to a person operating a hotel or motel containing 75 sleeping rooms or more under the following conditions:
a. With each original application or application for a transfer of a license issued under this subsection, the applicant shall furnish the governing body with seven detailed sketches of the hotel or motel of sufficient size to plainly show the designated sleeping rooms, the size of each room, entrances, exits, fire precautionary devices and the location and designation of all other rooms in the hotel. Each sketch shall be certified to by a licensed architect.
b. The sleeping room areas shall strictly conform to the requirements of all applicable ordinances of the Borough of Point Pleasant Beach and laws of the State of New Jersey.
c. A license issued pursuant to the provisions of this section shall not be transferred except to another hotel or motel containing 75 sleeping rooms or more.

4-3.3 No Change

SECTION II. All ordinances or parts thereof which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of their inconsistencies.

SECTION III. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.

SECTION IV. This Ordinance shall take effect immediately upon its final passage and publication as required by law.


NOTICE

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey, held on the 28th day of May 2013 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 18th day of June 2013 at 7:30 P.M. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place any person desiring to be heard will be given opportunity to be heard.
