ORDINANCE 2012-35 Fleet Vehicle Parking

ADOPTED: DECEMBER 18, 2012

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY, LIMITING THE PARKING OF FLEET VEHICLES ON PUBLIC STREETS, HIGHWAYS, AND ROADS IN
THE BOROUGH OF POINT PLEASANT BEACH


WHEREAS, the Borough Council of the Borough of Point Pleasant Beach has recognized the need to limit the parking of certain commercial vehicles on public streets, highways, and roads in the Borough of Point Pleasant Beach to ensure there is parking available to residents and to provide for the safe and secure travel along the public rights of way; and

WHEREAS, the Borough Council finds and determines that for the good and welfare of its citizens it is necessary and advisable to establish regulations that improve the quality of life for residents; and
WHEREAS, the Borough Council finds and determines that for the good and welfare of its citizens it is necessary and advisable to establish regulations and provide for the enforcement of parking regulations within the Borough;
NOW, THEREFORE, BE IT ORDAINED, by the Governing Body of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey, as follows:

SECTION I. Chapter IX of the Code of the Borough of Point Pleasant Beach, entitled “Traffic,” shall be amended at section 9-3A entitled “General Parking Regulations” by creating section 9-3A.3 “Limitation on Parking Fleet Vehicles”;
“9-3A.3 Limitation on Parking Fleet Vehicles
a. The term “fleet vehicles” shall be defined as a group or collection of commercial vehicles, whether or not of the same make and model, utilized by a commercial operator or business entity to carry out commercial activities.
b. There shall not be more than two (2) fleet vehicles parked on any public street, highway, or road in the Borough of Point Pleasant Beach between the hours of 9:00 p.m. and 6:00 a.m. of the following morning.
c. During the prohibited hours provided by subsection (b) above, Fleet Vehicles may only be parked in front of the property to which the vehicle is registered in the Borough.
SECTION II. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.
SECTION III. All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of their inconsistencies.
Section IV. Effective Date.
a. This Ordinance shall be effective as to all municipal roads beginning January 1, 2013.
b. This Ordinance shall be effective as to all Ocean County roads upon approval by Ocean County.
c. Should the County approve this Ordinance prior to January 1, 2013, this Ordinance shall be effective as to all Ocean County and municipal roads on January 1, 2013. Should the County not approve this Ordinance prior to January 1, 2013, this Ordinance shall be effective as to all municipal roads on January 1, 2013.

NOTICE

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 20th day of November 2012 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 18th day of December 2012 at 7:00 P.M. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place any person desiring to be heard will be given opportunity to be heard.
