ORDINANCE 2012-04 Open Space Committee Members

ADOPTED: March 20, 2012

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY AMENDING
CHAPTER XXIX “OPEN SPACE ADVISORY COMMITTEE” AT SECTION 29-2.2, ENTITLED “MEMBERSHIP OF
OPEN SPACE COMMITTEE”


BE IT ORDAINED by the Mayor & Council of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey as follows:

SECTION I. Chapter XXIX of the Code of the Borough of Point Pleasant Beach, entitled “Open Space Advisory Committee,” is hereby amended at Section 29-2.2 as follows:

“29-2.2 Membership of Open Space Committee.

The nine regular members and two, nonvoting, student members of the Open Space Committee shall be:
a. One member of the Environmental Commission to be appointed by the Environmental commission;
b. One member of the Planning Board to be appointed by the Planning Board, who shall not be a member of the Governing Body;
c. One member of the Recreation Committee to be appointed by the Recreation Committee;
d. One member of the Historic Preservation Commission to be appointed by the Historic Preservation Commission;
e. Two members of the Borough Council to be appointed by the Borough Council;
f. Three residents of the municipality, to be appointed by the Mayor, who shall not include the Mayor, an additional member of the Borough Council, a salaried or paid full-time or part-time employee of the Borough or a member of the Environmental Commission, the Planning Board, the Recreation Committee or the Historic Preservation Committee;
g. Two students in good standing matriculated at Point Pleasant Beach High School, who are residents of the borough, each appointed by the Student Council and approved by the school administration.

29-2.3 Alternate Members.
The five alternate members of the open space committee shall be:
a. One member of the Environmental Commission to be appointed by the Environmental Commission, who shall serve in the absence of the regular member appointed by the Environmental Commission;
b. One member of the Planning Board, who shall not be a member of the Governing Body, to be appointed by the Planning Board, who shall serve in the absence of the regular member appointed by the Planning Board;
c. One member of the Recreation Committee to be appointed by the Recreation Committee, who shall serve in the absence of the regular member appointed by the Recreation Committee;
d. One member of the Historic Preservation Commission to be appointed by the Historic Preservation Commission, who shall serve in the absence of the regular member appointed by Historic Preservation Commission.
e. One resident of the municipality, to be appointed by the Mayor, who shall serve in the absence of one of the three residents who are regular members of the Open Space Committee, and who shall not include the Mayor, an additional member of the Borough Council, a salaried or paid full-time or part-time employee of the Borough or a member of the Environmental Commission, the Planning Board, the Recreation Committee or the Historic Preservation Committee.”

SECTION II. All sections of Chapter II not amended hereunder shall remain in full force and effect.

SECTION III. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.

SECTION IV. All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.
SECTION V. This Ordinance shall take effect immediately upon its final passage and publication as required by law.


NOTICE


NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 6th day of March 2012 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 20th day of March 2012 at 7:00 p.m. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place any person desiring to be heard will be given an opportunity to be so heard.
