ORDINANCE 2012-08 Seasonal Rental & C O Fees

ADOPTED: March 6, 2012

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING THE CODE OF THE BOROUGH AT CHAPTER XIII,
ENTITLED “HOUSING,” AND AT CHAPTER XXVII ENTITLED
“SEASONAL RENTAL REGULATIONS” PERTAINING TO
SEASONAL RENTAL AND CERTIFICATE OF OCCUPANCY FEES

BE IT ORDAINED by the Borough Council of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey, as follows:

SECTION I. Chapter XIII of the Code of the Borough of Point Pleasant Beach, entitled “Housing,” shall be amended at Section 13-2.3, entitled “Fees,” as follows:

”13-2.3 Fees.
The filing fee will be one hundred fifty ($150.00) dollars for each filing. Re-inspection fees will be fifty ($50.00) dollars for inspection.

SECTION II. Chapter XXVII of the Code of the Borough of Point Pleasant Beach, entitled “Seasonal Rental Regulations,” shall be amended at Section 13-2.3, entitled “Seasonal Rental License Required,” as follows:

“ 27-3 Seasonal Rental License Required..
a. No person, corporation or partnership shall let or lease any furnished or unfurnished housing or living unit for seasonal residential purposes for occupancy including the period between Memorial Day and Labor Day, unless a license to let each such unit is first procured and kept in effect at all such times as required by this chapter or any other law or ordinance of the Borough of Point Pleasant Beach.
b. The fee for such license or renewal thereof shall be one hundred fifty ($150.00) dollars and the license shall be valid for the period between Memorial Day and Labor Day in the calendar year of its issue.
c. For any property subject to the hotel motel tax, Section 28-1 et seq. in the Code of the Borough of Point Pleasant Beach, the fee for such license or renewal thereof shall be one hundred fifty ($150.00) dollars for the season and shall encompass the entire building, and shall not apply to each of the individual living units therein.”

SECTION III. All sections of Chapters XIII and XXVII not amended hereunder shall remain in full force and effect.

SECTION IV. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.

SECTION VI. All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.

SECTION VII. This Ordinance shall take effect immediately upon its final passage and publication as required by law.


NOTICE

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 21st day of February 2012 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 6th day of March 2012 at 7:00 P.M. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place a person desiring to be heard will be given opportunity to be heard.
