ORDINANCE 2012-07 Waste Materials & Collection

ADOPTED: March 6, 2012

AN ORDINANCE OF THE BOROUGH OF POINT PLEASANT BEACH,
COUNTY OF OCEAN AND STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING THE CODE OF THE BOROUGH AT CHAPTER III
ENTITLED “POLICE REGULATIONS” PERTAINING TO
SECTION 3-8 ENTITLED “WASTE MATERIALS AND COLLECTION.”


BE IT ORDAINED by the Borough Council of the Borough of Point Pleasant Beach, County of Ocean and State of New Jersey, as follows:

SECTION I. Chapter III of the Code of the Borough of Point Pleasant Beach, entitled “Police Regulations,” shall be amended at Section 3-8.2, entitled “Preparation for Collection,” as follows:

”3-8.2 Preparation for Collection.

f. Receptacles.
1. The owner, tenant, occupant or operator of every dwelling, apartment, hotel, rooming house, store, motel, business, building, market, restaurant, residence, institutional establishment, or other premises in the borough where garbage shall accumulate, must provide and keep on such premises sufficient and suitable metal or plastic receptacles, cans or barrels, for receiving and holding the aforesaid materials. Proper trash and garbage bags, with proper and adequate seal, shall be considered adequate plastic receptacles for residential dwellings only and not for commercial establishments. The Borough recommends that residents use black or dark green plastic bags, rather than white bags, if plastic bags are to be used as plastic receptacles.
2. All receptacles used for the purposes described in subsection 3-8.1 and 3-8.2, at all times shall be of such a size and weight as can be easily handled by one man, and in no case shall exceed 60 pounds in weight. All receptacles shall be kept in an upright position. Except for plastic bags, all receptacles will be marked to designate the address of the residence or business to which it pertains. Plastic trash and garbage bags shall be kept closed and sealed.
3. At no time at one collection, shall more than four garbage or trash bags or equivalent covered receptacles be set out for collection from any individual private dwelling. No one receptacle shall exceed 45 gallons.

SECTION II. All sections of Chapter III not amended hereunder shall remain in full force and effect.

SECTION III. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid.

SECTION V. All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.

SECTION VI. This Ordinance shall take effect immediately upon its final passage and publication as required by law.

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed on first reading at the regular meeting of the Borough Council of the Borough of Point Pleasant Beach, in the County of Ocean, held on the 21st day of February 2012 and will be considered for second reading and final passage at the regular meeting of said governing body to be held on the 6th day of March 2012 at 7:00 P.M. in the Council Chambers, Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, New Jersey at which time and place a person desiring to be heard will be given opportunity to be heard.
