December 1, 2011

Minutes

The December 1, 2011 Regular meeting of the Board of Adjustment opened at 7:43pm. The clerk read the notice of compliance with the "Open public meetings act." Present were Board members: Wolfersberger, Spader, Struncius, Reilly, Kelly and Reynolds Alternates: Ardito, Renner and Loder
Absent: Palisi


Motion by Mr. Spader, second by Mr. Reynolds to memorialize the minutes from the November 3, 2011 meeting.

In favor: Spader, Reynolds, Ardito and Loder
Opposed: None



Memorialization the following resolutions

Motion by Mr. Spader, second by Mr. Reynolds to memorialize the action and vote approving application #2011-12 of Erick Erickson for certification of pre-existing non-conformity and installation of pavers

In favor: Spader, Reynolds, Ardito and Loder
Opposed: None


Motion by Mr. Ardito, second by Mr. Loder to memorialize the action and vote approving application #2011-13 of Thomas Cicalese with conditions –

#2011-17 – William C Mullins – 307 Philadelphia Avenue – Block 32; Lot 4 – Applicant wishes to renovate existing garage with new pitch to roof.

Applicant purchased home in March of 2011. Garage is falling down and he would like to renovate it and change the pitch of the roof to make more room for storage and to park his car. Existing garage has a rear setback of 2.78 and a side yard setback of 2.87. He would like to keep footprint. Mr. Spader inquired why he doesn’t want to knock down the garage and start fresh. Applicant stated it is cost efficient to keep the foot print. William Mullins has made a substantial investment upgrading the house. Mr. Reilly inquired if the neighbors have had any concerns. William Mullins replied that they are happy he is there. The home needed to be upgraded. Applicant stated there will be no plumbing or heating installed. Garage will be slate Blue with white trim and grey roof. Home will be sided to match garage in near future.

Deliberations

Mr. Wolfersberger – Have no problem; Pre existing conditions.
Mr. Spader – Has no problem with application. In favor

Mr. Loder – No objection; it is an improvement and that is what we are looking for.

Mr. Reilly - In favor; will not negatively impact neighbors.

Mr. Reynolds – every now and then we get a case that I wonder what are we doing here and this is one of them. In favor

Mr. Ardito – Improvements are a plus. In favor

Mr. Renner – Clarified that there will be no plumbing. In favor


Motion by Mr. Reynolds, second by Mr. Reilly to approve application #2011-17 of William C. Mullins with conditions.

Conditions

1. Garage is to be no higher than 16 feet measured from curb.
2. There is to be no plumbing.

Application approved with conditions


#2011-18 – Dominick Chirichella – 303 Atlantic Avenue – Block 61; Lot 2 – Applicant wishes to construct a two-story addition to existing single family dwelling.

Applicant proposes to add rear addition which will create 32% in building coverage. Applicant wishes to have additional room for his daughter and her family who is living with them. Ray Savacool stated that the coverage is accurate. Mr. Reilly inquired that the home will comply with flood damage code. (Yes) Ray Savacool clarified that there is a basement and that the old structure will not comply but the addition will. Mr. Spader inquired about the open second floor deck on the front of the home. The applicant stated that it has been removed. Mr. Spader commented that he liked the deck and would like to see it added back on to the plans; it added an aesthetic value to the home. The applicant replied that he also would like to have the front second floor deck added back on. Chairman Struncius agreed that the porch adds a pleasing roof line. Mr. Renner also agrees that it would add to the aesthetics.





Conditions

1. There are to be no temporary structures in the yard after the completion of the home.
2. Board agrees to allow applicant to install second floor front deck that is not to be enclosed.
3. Applicant is to submit architectural to the board prior to Memorialization.


Deliberations

Mr. Wolfersberger - Third time seeing this application. An application has been presented to vote on. In favor on voting on the application as is.

Mr. Spader - Thinks that the applicant has made adjustments from earlier application. Has taken a look at the surrounding properties and the home will not be out of place. Home is 14 feet off of the curb. Home is consistent with the seashore. Is in favor of the second floor deck.

Mr. Kelly – Is confused; hates to see the side porch go. No objection to the deck but wants to see what it will look like; Wants to see a drawing before deciding.

Mr. Reilly – Has changed his mind and would also be in favor of allowing the front second floor open deck.

Mr. Reynolds – I agree with Mr. Spader on this. I think that the porch will add an aesthetic value and match the home across the street.

Mr. Ardito – Appreciates their desire to come back; biggest concerns have been addressed. Doing what is best for your family. Has no problem with the second floor deck; Wants to see updated drawings before Memorialization.

Mr. Renner – Appreciates the work put into this application. Concerns have been met. In favor of the porch and the improved parking.

Chairman Struncius – Applicant has worked with board. In favor of the second floor front porch; has an aesthetic appeal and matches the character of the neighborhood.

Motion by second by to approve application 2011-18 of Dominick Chirichella with conditions and added second story porch.

In favor: Wolfersberger, Spader, Kelly, Chairman Struncius, Reilly, Reynolds and Ardito
Opposed: None

Motion by Mr. Reilly, second by Mr. Spader to approve the BOA Calendar dates for 2012.
