Minutes

The July 21, 2011 Regular meeting of the Point Pleasant Beach Board of Adjustment opened at 7:30 pm. The clerk read the notice of compliance with the "Open Public Meetings Act. Present were regular members: Mr. Wolfersberger, Mr. Spader, Mr. Palisi, Mr. Kelly, Chairman Struncius, Mr. Reilly, Mr. Reynolds, Mr. Ardito, Mr. Renner and Mr. Loder

Absent: Mr. Ardito


Motion by Mr. Kelly second by Mr. Reynolds to memorialize the minutes of June 16, 2011

In favor: Wolfersberger, Kelly, Reynolds, Renner and Loder

Motion by Mr. Reynolds, second by Mr. Palisi to memorialize the action and vote approving application #2009-19 of Sandra Napoletano with conditions

In favor: Reynolds and Palisi

Motion by Mr. Wolfersberger, second by Mr. Reynolds to memorialize the action and vote approving application #2011-10 of Ralph and Geriann Rotando with conditions

Discussion to reconsider -Application #2010-05 – Robert and Irene Morrow – 209 Arnold Avenue – Block 97; Lot 5 – Applicant wishes to construct a two-story addition to the rear of the front house and a second story deck to the rear dwelling.

John Jackson attorney for applicant thanked the board for the reconsideration. Entered four (4) pictures of the layout of the second floor as A-15. Robert Morrow, applicant described the pictures. Mr. Palisi has listened to a prior meeting and has signed a certification and now is eligible to vote on this application. Mr. Kelly had explained that his concern had always been density, not rentals and that seeing the photos helped alleviate his concerns.

Deliberations:

Mr. Palisi – after listening to audio, concerned about parking; somewhat mixed feelings but not enough to change Mr. Ardito’s vote. In favor

Mr. Reilly – Having thought more about the application and seeing the pictures of the upstairs’ open space, is now in favor.

Mr. Kelly – My comments are practically the same as before. I believe you will still have trouble parking, but it is for family and you will figure it out. I have changed my mind after seeing the photos of the upstairs.

Reynolds – Still in favor

Mr. Renner – Still in favor

Mr. Spader – Point Beach has an opportunity to address multiple rentals on one property. The applicant is looking for something special. When there is non-conformity we can look to get a gift in return. We are loading the gun for a change in ownership. What about the neighbor’s? I am still a negative vote.

Application #2011-06 - Daryl and Susan Pregibon – 314 Elizabeth Avenue – Block 20; Lot 13.04 – Applicant wishes to add an 8 foot by 10 foot shed and a 10 foot by 18 foot exercise pool.

Susan Pregibon, applicant sworn. Dean Daley, professional Architect. Intent of applicant is just to add a shed to house the pool mechanicals and lawn mower. The shed will be sided to match the home.

Deliberations

Wolfersberger – Mr. Wolfersberger stated the 1.43% building coverage is deminimus and it is good to house the mechanicals, inclined to be in favor

1. Shed is to match the home
2. Mechanicals are to be in the shed.

Application #2011-11- Matthew Rega – 337 Curtis Avenue – Block 92; Lot 8 - Applicant wishes to construct a 7 foot by 36 foot open front porch to existing family dwelling

Application #2011-08 – Dominick Chirichella – 303 Atlantic Avenue – Applicant wishes to construct a two story addition to existing family dwelling.

Steven A. Pardes, attorney for applicant. Frances Chirichella, applicant sworn. Applicant explained reasons for the addition to the home. Home originally built by Risden’s who sold it to the applicant’s family 70 years ago. It is their principal residence. Applicant now has family members moving in with her (daughter, husband and children) and they would like more room. Dominick Chirichella, applicant sworn, reads his wife’s letter (statement) into testimony. Wife has degenerative arthritis and has trouble getting around. They have two other grown children which visit quite often. Lot is 125 feet deep and even with the addition the rear setback will comply. Exhibit entered as A-3 Picture taken approximately three (3) weeks ago shows rear yard tree line and six (6) foot fence. Trees are about 30 feet high that would screen home from rear home. Proposed addition would be compliant with all other setbacks.

Steven Lido, Professional Architect. Went to NJIT and continues his education at the Harvard School if design. Member of the American Institute of Architects, credentials accepted.

Exhibits entered - A-4 Floor and Site plan; A-5 Exterior elevations and A-6 - Four (4) photos taken two (2) months ago. Existing structure is a simple two-story bungalow style home. Current square footage is approximately 2,500 square feet. Proposed addition will comply with setbacks requirements. Proposing two-story addition which would add a family room to the first floor, slightly enlarge the kitchen; add a master bedroom, master bathroom and a powder room to the first floor. The second floor would maintain the 4 existing bedrooms plus add three more bedrooms, two bathrooms and one laundry room. The master bedroom on the first floor would be for the Chirichella’s.

Exterior of home will be consistent of the rest of the home. Proposing to maintain character of home; reviewed elevations, roof structure will be trust style. Basement access will still be through Bilco door in rear of home. Total square footage of proposed home is 4,736 square feet. Mr. Spader commented that with all the physical problems that he is surprised to see that there are not any handicap ramps. Chairman Struncius inquired if the homes to the East and West aligned with this home. Dominick Chirichella replied that the front setbacks are similar. Chairman Struncius replied that the massing of the home would affect the neighboring light. Mr. Kelly inquired about the height of the existing and proposed home and also about all the slider doors and stairs that are not pictured. Ray Savacool said that there is not a deck considered in the 41% building coverage. Steven Lido replied “that there is no deck at this time”.

Mike Palisi inquired about the fact that the applicant keeps mentioning all the needs of the disabled family members but does not see any improvements to accommodate the disabled. Mr. Chirichella said they would utilize portable ramps. Mr. Palisi said we have to have some sense of reason because this is a lot of building coverage. You need to look at “is there something smaller than 41% to accommodate your needs? “Mr. Kelly has a concern in regards to exiting the upstairs in case of emergency. Mr. Spader inquired if the applicant has a plan “B”; in all his years on the board he has never seen a home this big. This home is huge; over one third bigger on an oversized lot.

Steven A. Pardes waived the time for the application to be heard.

On a motion by Mr. Wolfersberger, second by Mr. Reilly to application #2011-08 of Dominick Chirichella to September 18, 2011 without notice.
